Welcome to Eliza Moffat Studio. By accessing our website, purchasing original artwork, or commissioning custom work, you agree to be bound by the following Terms of Service. Please read them carefully before placing an order.

1. Intellectual Property & Copyright Retention

  • Copyright Ownership: All artwork, original oil paintings, fine art prints, images, text, logos, and digital media created by Eliza Moffat are the exclusive intellectual property of Eliza Moffat Studio and are protected under international copyright and trademark laws.

  • Reproduction Rights: The sale of an original painting, print, or custom commission transfers ownership of the physical artwork only. It does not transfer copyright, reproduction, or commercial distribution rights. Eliza Moffat Studio retains all rights to reproduce, create prints, publish, and license image rights for all created artwork.

  • Personal Use Only: Purchased artwork and prints may not be resold commercially, scanned, reproduced, or used for commercial branding without prior written consent from Eliza Moffat Studio.

2. Prohibition on AI Scraping & Data Mining

All visual content on this site is protected against unauthorized data extraction. Eliza Moffat Studio strictly prohibits the use, scraping, crawling, harvesting, or extraction of any artwork, photographs, or text on this site for the purpose of training machine learning models, artificial intelligence (AI) algorithms, deep learning datasets, or generative media platforms. Any unauthorized automated scraping of content from this domain constitutes copyright infringement.

3. Purchasing, Pricing & Color Accuracy

  • Pricing: All prices are listed in USD. Eliza Moffat Studio reserves the right to adjust artwork prices, shipping rates, or availability at any time without prior notice.

  • Color Accuracy: We make every effort to display the colors, textures, and details of original oil paintings accurately. However, because display settings, lighting, and screen resolutions vary across devices, slight variations in color between the screen display and the physical piece may occur.

4. Shipping, Fulfillment & Drying Time

  • Oil Paint Curing Period: Original oil paintings require natural curing and drying time prior to varnishing and safe shipment. Freshly completed works may require 2 to 6 weeks of studio drying time before dispatch. Estimated ship dates will be stated on product pages or communicated post-purchase.

  • Transit & Risk of Loss: Title and risk of loss pass to the buyer upon delivery of the shipment to the carrier. High-value original works are shipped with insurance and delivery tracking.

5. Final Sale & Refund Policy

  • Final Sale: Due to the delicate, hand-crafted nature of original oil paintings and fine art prints, all sales are final. We do not accept returns, exchanges, or cancellations once an order has shipped.

  • Damaged Shipments: If your artwork arrives damaged in transit, you must notify Eliza Moffat Studio at eliza@elizamoffatstudio.com within 48 hours of delivery. Please include photographs of the outer packaging and the damaged artwork so an insurance claim can be processed promptly.

6. Custom Commissions

  • Deposits & Payments: Custom oil painting commissions require a non-refundable deposit (typically 50%) prior to the commencement of work, with the remaining balance due upon completion and prior to delivery.

  • Approval & Modifications: Commission clients will receive updates and final proof photos. Once the final piece is approved and completed, the balance is non-refundable.

7. Governing Law

These Terms of Service and any separate agreements regarding studio purchases shall be governed by and construed in accordance with the laws of the State of Ohio, United States.
